A Ukrainian employer needs more than a weekly total. State Statistics Committee Order No. 489 approves Form P-5 for recording working-time use, including regular hours, part-time hours, night hours, overtime, and weekend or holiday work. A practical app structure should keep those categories visible instead of burying them in comments.
Ukraine's Labour Code sets normal working time at no more than 40 hours per week, with lower standards possible by collective agreement. During martial law, employees at critical infrastructure facilities can have normal working time increased to 60 hours per week, while employees with legally reduced working time at those facilities may not exceed 40 hours per week.
The Labour Code requires per-employee overtime records. Overtime work may not exceed 4 hours over 2 consecutive days or 120 hours per year. For hourly-paid employees, overtime is paid at double the hourly rate. For piece-rate employees, the surcharge is 100% of the relevant hourly base salary, and compensatory time off is not allowed.
Night time runs from 10 p.m. to 6 a.m. under the Labour Code, and night work is generally paid at an increased rate of at least 20% of base salary for each night hour. A time record should therefore separate a 9 p.m. to 2 a.m. shift into ordinary hours and night hours instead of storing only one five-hour entry.
Remote employees in Ukraine may divide working time at their own discretion unless the contract says otherwise, but total working hours may not exceed the Labour Code's normal or reduced working-time standards. A time tracking setup should still collect the date, person, task or project, start and end time where needed, and working-time category.
Employee time-tracking data can be personal data under Law No. 2297-VI because it relates to an identified or identifiable person. Processing should have a valid legal ground and stay specific, legitimate, transparent, adequate, and non-excessive.
