How Iran overtime pay is calculated

What this calculation answers

For Iran payroll, the core question is how much extra pay is due when a worker's approved hours exceed ordinary working time. Iran Labour Law Article 51 sets the ordinary daily working-hours limit at 8 hours, and ordinary weekly hours must not exceed 44 hours. Overtime under Article 59 requires the worker's consent and payment of 40% in addition to the wage for each ordinary hour.

The result gives you ordinary pay, overtime pay, and total gross pay before deductions or other allowances. It does not decide whether the schedule itself is lawful in every case. You still need to check daily overtime limits, shift-work averaging, Friday rest-day treatment, night-work premiums, hard or hazardous work restrictions, and any collective labor contract that gives benefits above the Labour Law floor.

Apply the Iran formula

Start with the worker's ordinary hourly wage. Pay ordinary hours at 1x until the applicable ordinary limit is reached. For standard weekly overtime, multiply overtime hours by 1.4 because Iran's Labour Law requires 40% in addition to the wage for each ordinary hour. The basic weekly formula is: ordinary pay plus overtime hours multiplied by ordinary hourly wage multiplied by 1.4.

Example: a worker earns 1,200,000 rials per hour and works 50 approved hours in a week with no special Friday, night, shift-work, or hazardous-work issue. Ordinary pay is 44 hours × 1,200,000 rials = 52,800,000 rials. Overtime pay is 6 hours × 1,680,000 rials = 10,080,000 rials. Total gross pay is 62,880,000 rials.

Check Iran-specific limits

The biggest mistake is treating every hour above 44 as just another premium hour. Normal overtime assigned to a worker must not exceed 4 hours per day, except in exceptional cases by mutual agreement. Emergency overtime for accident prevention, damage recovery, or resuming work after mishaps or natural calamities can reach 8 hours per day, but it requires local labour-office notification within 48 hours.

Hard, hazardous, and underground jobs follow a stricter baseline: 6 hours per day and 36 hours per week, with overtime prohibited for workers doing dangerous, hard, or hazardous work. Shift work can exceed 8 hours in a day or 44 hours in a week, but total working hours over four consecutive weeks must not exceed 176 hours. These rules change whether the calculator result is usable for payroll approval.

When a calculator is enough

A one-off calculation is enough when you have a single worker, a clear hourly wage, approved ordinary hours, approved overtime hours, and no special classification issue. It also works for checking an invoice line, confirming a payroll draft, or explaining why a weekly total changed after overtime was added. Use 44 ordinary hours per week for the standard Iran overtime calculation. Keep these premiums separate from ordinary weekly overtime unless your payroll policy or contract defines how they interact.

Do hard or hazardous jobs use the same overtime calculation?

No. Hard, hazardous, and underground jobs are limited to 6 hours per day and 36 hours per week, and Article 61 prohibits assigning overtime to workers doing dangerous, hard, or hazardous work. For those workers, the main issue is not the 1.4x formula; it is whether overtime can be assigned at all.
