How Portugal time and a half works

What this calculation answers

A time and a half calculation in Portugal answers one narrow question: when should an overtime hour be paid at 150% of the statutory hourly rate? Under Portugal's Labour Code, that rate applies to overtime on a weekly rest day or public holiday during the first 100 annual overtime hours. It also applies to the first working-day overtime hour once the worker has already exceeded 100 annual overtime hours.

The result is not a universal overtime rate. Portugal's normal working period is no more than 8 hours per day and 40 hours per week, subject to specific averaging and collective-agreement regimes. The premium changes by timing, annual overtime total, and whether a collective labour regulation instrument sets a different applicable rule.

Use the statutory hourly rate

Portugal's Labour Code hourly-rate formula is `(monthly pay × 12) ÷ (52 × weekly hours)`. If a worker earns €1,820 per month and has a 40-hour normal week, the hourly rate is €10.50. For a weekly rest day overtime hour within the first 100 annual overtime hours, time and a half is €15.75 per hour.

For example, 4 overtime hours on a weekly rest day before the worker reaches 100 annual overtime hours pay €63.00 in overtime pay: 4 hours × €15.75. Keep the annual overtime count separate from the weekly total because the same 4 hours change rate once the worker passes 100 annual overtime hours.

The common mistake is treating every overtime hour as time and a half. During the first 100 annual overtime hours, working-day overtime pays 125% for the first hour or fraction and 137.5% for later hours or fractions. Weekly rest day or public holiday overtime pays 150% during that same annual band.

After 100 annual overtime hours, the categories change. Working-day overtime pays 150% for the first hour or fraction and 175% for later hours or fractions. Weekly rest day or public holiday overtime pays 200%, which is double time. Also check caps: annual overtime is capped at 150, 175, or 200 hours depending on company size and collective labour regulation.

When a calculator is enough

A one-off calculator is enough when you have the worker's monthly pay, normal weekly hours, annual overtime total, overtime date type, and the exact overtime hours.
