How German overtime pay works

What this calculation answers

The practical question is not only "how much extra pay is due?" In Germany, the first question is which premium applies. The Arbeitszeitgesetz (ArbZG) sets working-time limits, rest breaks, rest periods, and Sunday or public-holiday restrictions, but it does not set a nationwide 1.5x or 2x overtime premium.

For pay, use the rate named in the employment contract, collective agreement, or works agreement. If the arrangement does not state a premium, BGB section 612 supports implied or usual remuneration where pay is expected. The calculator result gives gross overtime pay before payroll deductions, not a final net wage.

Use the contract multiplier

Start with the regular hourly rate, eligible overtime hours, and the contractual or collectively agreed multiplier. A 25% premium is entered as 1.25x, a 50% premium as 1.5x, and paid time off in lieu is handled outside the cash calculation unless the agreement converts it to pay.

Example: an employee earns €24 per hour, has a 40-hour contractual week, and works 44 payable hours. Regular pay is 40 × €24 = €960. If the applicable agreement pays overtime at 1.25x, the overtime rate is €30. Four overtime hours equal €120, for total gross pay of €1,080.

Check ArbZG limits first

Under ArbZG section 3, employees' working time may not exceed eight hours per working day. Daily working time can extend up to ten hours only if the average over six calendar months or 24 weeks does not exceed eight hours per working day. The normal average cap is effectively 48 hours across a six-day working week.

Do not treat a paid premium as permission to ignore rest rules. Work over six and up to nine hours requires at least 30 minutes of breaks; work over nine hours requires at least 45 minutes. Employees must receive at least eleven uninterrupted hours of rest after the daily working period, subject only to limited sector reductions with compensating rest.

Calculator or managed workflow

A calculator is enough for a one-off gross pay check when you already know the employee's eligible hours, regular rate, and agreement-based multiplier. Use the same check to confirm that the proposed payment clears the €13.90 gross per hour general statutory minimum wage floor in effect since January 1, 2026.

A pay premium still comes from the applicable agreement, not a nationwide default.
