A Virginia break calculation answers one practical question: how many hours on the timesheet are paid after breaks are applied. For adult private-sector employees, Virginia has no general state meal-break requirement and no state paid-rest-break requirement. Federal law also does not require adult lunch or coffee breaks, so an adult break entitlement usually comes from policy, contract, collective bargaining agreement, or a worker-specific rule.
The calculation still matters because break treatment changes paid hours. Short breaks running about 5 to 20 minutes count as hours worked under federal wage-hour rules. A bona fide meal period is generally unpaid only when the employee is completely relieved from duty for a regular meal. A working lunch stays paid time because the employee is still performing duties.
For adults, the first decision is whether the break exists because of employer policy rather than a general Virginia mandate. If the policy grants two 10-minute rest breaks, those minutes stay paid. If the policy grants a 30-minute lunch and the employee is completely relieved of duty, those minutes can be unpaid. A manager who interrupts the lunch with work turns that meal time back into compensable hours worked.
Minors require a separate check. Virginia child labor law says a child may not work more than five hours continuously without an interval of at least 30 minutes for lunch. A period shorter than 30 minutes does not interrupt that continuous work period. Employers of minors under 16 must keep records showing daily start and end times and the free-from-duty meal period, with required records retained for the stated 36-month period.
Start with the shift span, subtract only unpaid bona fide meal time, and keep paid short breaks inside paid hours. For example, a Virginia employee works a 10-hour shift at $28 per hour, takes two paid 15-minute rest breaks, and takes one duty-free 45-minute meal period. The paid rest breaks remain in the total. The unpaid meal period is the only subtraction.
Paid time is 10 hours minus 0.75 hours, or 9.25 hours. Straight-time gross pay is 9.25 hours times $28, or $259.00, before taxes, deductions, premiums, covered nonexempt weekly overtime, or policy-based payments. If the employee works during the meal, paid time becomes the full 10 hours, and straight-time gross pay becomes $280.00.

It is also enough for a quick adult private-sector check in Virginia because the core adult rule is usually federal paid/unpaid break treatment plus employer policy.
