How overtime pay works in Italy

What this calculation answers

An Italy overtime calculation answers three practical questions: how many hours exceed the applicable normal working time, which premium or compensatory rest rule applies under the worker's CCNL, and whether the schedule stays inside statutory guardrails. Italy's normal full-time working time is 40 hours per week, although collective labor agreements can set a shorter normal duration and average it over a period not exceeding one year.

The result matters for payroll, staffing, and compliance review because Italian law does not set one universal 1.5x overtime multiplier. Legislative Decree No. 66/2003 defines overtime as work beyond normal working time, while the applicable collective agreement usually sets the wage increase, rest alternative, or both. The calculator output gives the cash amount; the agreement confirms whether that amount is the correct one.

Apply the agreement formula

Start with the normal-hour threshold, then subtract it from total weekly hours. Multiply regular hours by the base hourly rate. Multiply overtime hours by the hourly rate plus the CCNL premium. If the agreement grants compensatory rest instead of extra cash, keep the overtime hours separate and record the rest entitlement rather than forcing a cash-only answer.

Example: an Italian employee works 46 hours in a week at €19 per hour. The applicable CCNL sets a 25% overtime premium for those extra weekday hours. Regular pay is 40 × €19 = €760. Overtime pay is 6 × €23.75 = €142.50. Total gross pay for the week is €902.50 before taxes, deductions, allowances, and any other agreement-specific items.

Check Italian guardrails

The overtime amount is only one part of the check. Average working time in Italy may not exceed 48 hours for each seven-day period, including overtime. That average is normally calculated over a reference period not exceeding four months, but collective agreements can extend it to six months or to twelve months for objective, technical, or organizational reasons.

Do not treat 48 hours as a weekly overtime trigger. It is an average maximum, not a premium threshold. Also check rest: employees are entitled to 11 consecutive hours of rest in every 24-hour period and at least 24 consecutive hours of weekly rest every seven days, normally on Sunday and combined with daily rest, subject to statutory and collective-agreement exceptions.

When a calculator is enough

A one-off calculation is enough when you have a completed week, a known hourly rate, the correct CCNL premium, and no holiday, night, rest-day, or compensatory-rest issue. It is also enough for a quick estimate before payroll checks the agreement text.
